Gymnastics Lessons Waiver and Release of Liability

This Waiver and Release of Liability (the "Waiver") is executed on this date by the Parent/Guardian in favor of the Instructor, a corporation, its directors, officers, employees, volunteers, and agents (collectively, "Instructor").

1. Acknowledgment of Risk
   I, the undersigned Parent/Guardian, on behalf of myself and my minor child(ren), acknowledge that gymnastics is an activity that involves certain risks, including but not limited to physical injury, damage to property, or other harm that may be sustained while participating in gymnastics lessons conducted in the home environment. I understand that these risks are inherent in the nature of the activity and cannot be eliminated without jeopardizing the essential qualities of the activity.

2. Consent to Participate
   I hereby consent to allow my minor child to participate in gymnastics lessons provided by the Instructor in our home. I represent that my child(ren) is/are in good health and physically capable of participating in the gymnastics activities.

3. Waiver and Release
   In consideration of the Instructor allowing my child(ren) to participate in gymnastics lessons, I, on behalf of myself and my child(ren), hereby release, waive, discharge, and covenant not to sue the Instructor from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by my child(ren) or to any property belonging to me or my child(ren), whether caused by the negligence of the Instructor or otherwise, while participating in such activities, or while in, on, or upon the premises where the activities are being conducted.

4. Indemnification
   I further agree to indemnify and hold harmless the Instructor from any loss, liability, damage, or costs, including court costs and attorneys' fees, that may incur due to my child(ren)'s participation in gymnastics lessons, whether caused by negligence of the Instructor or otherwise.

5. Emergency Medical Treatment
   In the event of an emergency, I give permission to the Instructor to seek medical treatment for my child(ren) and authorize medical personnel to provide necessary and appropriate care. I understand that I will be responsible for any and all medical expenses incurred.

6. Governing Law
   This Waiver shall be governed by and construed in accordance with the laws of the State of California.

7. Severability
   If any provision of this Waiver is found to be unenforceable or invalid, that provision shall be severed from this Waiver and the remaining provisions shall be enforceable to the fullest extent permitted by law.

I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
